4.  REFERRALS, AFFILIATED ENTITIES AND PARTNERS — INFORMATION SHARING

Company operates as part of a family of businesses and may share your Personal Information freely with its current and future Affiliates for any legitimate business purpose. This Section governs that sharing.

4.1  Scope of Affiliates.  “Affiliates” is defined broadly and includes: (a) any entity currently or in the future owned by, under common control with, or otherwise related to Company; (b) any company Company acquires, invests in, merges with, or enters into a joint venture with; (c) any co-branded platform, community site, premium service, or consultation service that operates in connection with or under license from Company; (d) any successor or acquiror entity that continues any portion of Company’s business; and (e) any entity with which Company enters into a significant commercial or operational relationship. Affiliates that operate their own products and services may have their own privacy policies governing their independent data practices.

4.5  Not a Sale or Sharing for Advertising.  Disclosure of Personal Information to Company’s Affiliates as described in this Section is not a “sale” or “sharing” of Personal Information under the CCPA/CPRA or other applicable privacy laws, as Affiliates are part of Company’s common enterprise and are not independent third parties receiving information for independent commercial exploitation or targeted advertising.

5.  OTHER SHARING AND DISCLOSURE

In addition to Affiliate sharing described in Section 4, Company may disclose Personal Information in the following circumstances, among others. Company reserves the right to share information in additional circumstances not described below where it has a legitimate business purpose or legal basis to do so.

5.A  Service Providers.  Company may engage Service Providers to perform functions on its behalf, including payment processing, cloud hosting and infrastructure, email and SMS delivery, customer support, analytics, CRM and marketing automation, security and fraud detection, and any other service Company deems appropriate. Service Providers receive Personal Information only as necessary to perform contracted services. Company may change, add, or remove Service Providers at any time without notice.

5.B  Analytics and Marketing Partners.  Company may use analytics and marketing technology platforms that collect information about your use of the Services through cookies and similar technologies. These may include, among others, Google Analytics, email marketing platforms, CRM tools, and marketing automation systems. These partners may operate under their own privacy policies. Company does not authorize these partners to sell or use your information for their own independent advertising not connected to the Services.

5.C  Professional Consultants and Partners.  If you engage a consultant, professional, or partner through the Services, Company may share relevant account and property information with that person or entity to facilitate the engagement.

5.D  Legal Requirements and Protection of Rights.  Company may disclose Personal Information: (a) in response to applicable law, regulation, subpoena, court order, or lawful governmental request, without notice to you; (b) to enforce its Terms of Service, this Policy, or other agreements; (c) to detect, prevent, or address fraud, security incidents, technical issues, or misconduct; (d) to protect the safety, rights, property, or interests of Company, its Affiliates, users, or the public; or (e) in connection with any legal proceeding.

5.E  Business Transfers.  Company may transfer, sell, assign, or otherwise disclose Personal Information as part of any merger, acquisition, financing, reorganization, bankruptcy, asset sale, or similar corporate transaction, whether involving all or a portion of Company’s business or assets. Personal Information may be transferred to buyers, investors, or successors who may use it in accordance with their own privacy policies. Company may provide notice of material changes to privacy practices following a business transfer but is not obligated to do so beyond what applicable law requires.

5.F  With Your Consent or at Your Direction.  Company may share Personal Information with any third party when you provide express consent or direct Company to do so.

5.G  No Sale.  Company does not sell your Personal Information to unaffiliated third-party advertisers or data brokers, and has not done so in the preceding twelve (12) months. Company does not share Personal Information for cross-context behavioral advertising to unaffiliated third parties.

6.  DATA RETENTION

Company may retain Personal Information for as long as it deems reasonably necessary for the purposes described in this Policy, including to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, and pursue legitimate business interests. The following periods are illustrative guidelines and not absolute limits; actual retention may vary based on operational, legal, regulatory, or business considerations.

  • Active Account Data  Generally retained throughout the life of your account and for a period thereafter as Company deems appropriate, during which you may export your data through available tools.
  • Financial and Transaction Records  Generally retained for up to seven (7) years or such longer period as may be required for tax, accounting, audit, or legal compliance purposes.
  • Property and Investment Data  Generally retained for the life of your account. Company may retain copies in backup systems for additional periods for disaster recovery purposes.
  • System Logs and Security Data  Generally retained for up to twenty-four (24) months, or longer for security, fraud prevention, or legal purposes.
  • Backup and Archive Data  Data stored in backup, archive, or disaster recovery systems may be retained for additional periods beyond the above and may not be immediately deletable upon request.
  • Marketing Suppression Lists  Opt-out and suppression records may be retained indefinitely to honor your preferences.
  • Legal Hold Data  Data subject to a legal hold, litigation, or regulatory investigation may be retained until the matter is fully resolved, regardless of other retention periods.
  • Aggregated or De-identified Data  May be retained and used indefinitely, as it does not constitute Personal Information.

Company reserves the right to retain Personal Information for longer periods than those described above where it has a legitimate purpose to do so. Where deletion of Personal Information is impracticable — such as data stored in backup archives or systems not designed for granular deletion — Company may isolate such data from active processing until deletion is feasible.

7.  DATA SECURITY

7.1  Security Measures.  Company employs commercially reasonable technical, administrative safeguards designed to protect Personal Information against unauthorized access, disclosure, alteration, and destruction. The specific measures Company uses may change from time to time as technology and threats evolve. Company does not warrant or represent that any particular measure is or will remain in place.

7.2  No Guarantee of Security.  NO SECURITY SYSTEM IS IMPENETRABLE. COMPANY CANNOT AND DOES NOT GUARANTEE THE ABSOLUTE SECURITY OF PERSONAL INFORMATION, AND COMPANY DISCLAIMS ANY REPRESENTATION THAT THE SERVICES OR ANY DATA TRANSMITTED TO OR STORED BY COMPANY IS COMPLETELY SECURE. YOU TRANSMIT PERSONAL INFORMATION TO COMPANY AT YOUR OWN RISK. If you believe your information may have been compromised, contact Company immediately.

7.3  Breach Notification.  In the event of a security incident affecting your Personal Information, Company will provide notification as required by applicable law. The timing, content, and method of notification will be determined by Company in its reasonable discretion and in compliance with applicable breach notification statutes. Company’s obligations with respect to breach notification are limited to what applicable law requires; no additional obligations are created by this Policy.

8.  COOKIES AND TRACKING TECHNOLOGIES

BY USING THE SERVICES IN ANY MANNER, YOU EXPRESSLY CONSENT TO COMPANY’S USE OF COOKIES AND ALL TRACKING TECHNOLOGIES DESCRIBED IN THIS SECTION, INCLUDING THOSE DEPLOYED BY AFFILIATES, SERVICE PROVIDERS, AND AUTHORIZED THIRD-PARTY PARTNERS OPERATING ON COMPANY’S BEHALF, FOR ALL PURPOSES SET FORTH BELOW.

8.1  Tracking Technologies.  Company and its Affiliates, Service Providers, and authorized partners may deploy and use any of the following technologies on the Services, in emails and text messages, on affiliated websites and platforms, and in any other context in which you interact with Company, including but not limited to:

  • Pixel Tags, Web Beacons, and Clear GIFs:  tiny transparent images and other tracking elements embedded in web pages, emails, text messages, documents, and any other content;
  • Local and Session Storage:  HTML5 local storage, session storage, IndexedDB, and any other browser-based storage mechanism for performance, functionality, and analytics;

  • Third-Party Tags and SDKs:  JavaScript tags, SDKs, and tracking pixels provided by analytics, marketing automation, CRM, and other third-party platforms operating on Company’s behalf;
  • Cross-Device and Cross-Session Tracking:  technologies that recognize your account, browser, or device across multiple websites, applications, platforms, or time periods;
  • Communication Tracking:  tracking links and engagement pixels embedded in emails, SMS messages, and other communications to measure open rates, click rates, and engagement;
  • Other Technologies:  any other present or future technology that collects information about your interactions with Company, its Affiliates, or the Services.

8.2  Purposes.  Company may use cookies and tracking technologies for any legitimate business purpose, including but not limited to: authentication and security; service functionality and preferences; performance monitoring and diagnostics; user behavior analytics; product improvement; email and SMS engagement tracking; marketing effectiveness measurement; personalization; cross-session and cross-device user recognition; fraud detection; legal compliance; and any other purpose consistent with Company’s business operations. This list is illustrative and not exhaustive.

8.3  Categories of Cookies.  By using the Services, you consent to all categories of cookies Company may deploy, including strictly necessary cookies (required for basic functionality and cannot be disabled); functional and preference cookies (remembering your settings and customizations); analytics and performance cookies (measuring usage and improving the Services, including via Google Analytics); marketing and communications cookies (tracking engagement with Company’s emails, texts, and content); and cross-device and session continuity cookies (recognizing you across sessions, browsers, and devices).

8.4  Third-Party Cookies.  Third-party Service Providers and Affiliates may set cookies and similar technologies on the Services. Their use of such technologies is governed by their own privacy policies. Company does not control third-party cookie practices and makes no representations about them beyond the contractual obligations Company imposes on its Service Providers.

8.5  Cookie Choices.  You may manage cookies through your browser settings. However, disabling strictly necessary cookies will prevent you from using core features of the Services. Company is not responsible for any degradation in service caused by your choice to limit cookies. For users in jurisdictions requiring consent to non-essential cookies, Company may present a cookie preference interface; your continued use of the Services after any such interface constitutes your consent. Cookie preferences may not be honored across all browsers, devices, or sessions.

9.  CONSENT TO CONTACT — EMAIL, TEXT, AND TELEPHONE

BY CREATING AN ACCOUNT, PROVIDING YOUR CONTACT INFORMATION, OR ACCEPTING THIS PRIVACY POLICY, YOU EXPRESSLY PROVIDE YOUR “PRIOR EXPRESS WRITTEN CONSENT” UNDER THE TELEPHONE CONSUMER PROTECTION ACT (47 U.S.C. § 227) AND THE FTC’S TELEMARKETING SALES RULE TO RECEIVE COMMUNICATIONS FROM COMPANY, ITS AFFILIATES, AND THEIR AUTHORIZED AGENTS VIA EMAIL, TEXT/SMS, AND TELEPHONE AS DESCRIBED BELOW.

9.1  Email Communications.  You consent to receive email communications from Company and its Affiliates at the email address(es) you provide, including but not limited to: transactional and account messages; payment and billing notices; security alerts; legal and policy notices; marketing and promotional emails; newsletters; product updates and announcements; investment tips and educational content; survey and feedback requests; and any other communication Company or its Affiliates deem appropriate. You may opt out of marketing emails by clicking “Unsubscribe” in any marketing message. Company will honor marketing opt-outs as required by applicable law. You may continue to receive transactional and service messages while your account remains active.

9.2  Text and SMS Communications.  You consent to receive text and SMS messages from Company, its Affiliates, and their authorized representatives at any mobile telephone number you provide, including but not limited to: account alerts and security notifications; payment and billing reminders; marketing and promotional messages; product updates and announcements; event invitations; service and support messages; and any other message Company or its Affiliates deem appropriate. Message frequency may vary. Standard message and data rates may apply. You may opt out of marketing text messages by replying STOP to any marketing text or contacting Company. 9.3  Telephone Communications.  You consent to receive telephone calls from Company, its Affiliates, and their authorized agents at any telephone number you provide, including calls made using an automatic telephone dialing system, predictive dialer, or prerecorded or artificial voice messages, for any purpose including: account and subscription support; sales and marketing calls regarding Company’s products and those of its Affiliates; investor consultation scheduling and follow-up; event invitations; fraud prevention; and any other purpose Company deems appropriate. You may withdraw consent by notifying Comany.

9.4  Do Not Call — Consent Exemption.  The consent provided under this Section 9 constitutes prior express written consent under the TCPA and FTC Telemarketing Sales Rule, and supersedes any registration you may have made on the National Do Not Call Registry or any state do-not-call list with respect to contacts by or on behalf of Company and its Affiliates. The Do Not Call provisions of the TCPA and FTC regulations expressly exempt calls and texts made with prior express written consent and calls made to persons with whom the caller has an established business relationship. By accepting this Policy and using the Services, you provide both. If you wish to be added to Company’s internal do-not-contact list, Company will honor such requests as required by applicable law.

9.5  Scope — Affiliates and Authorized Agents.  The consent provided under this Section 9 extends to Company, all current and future Affiliates, and any third party authorized to contact you on their behalf. You may be contacted by any such party using any of the channels described in this Section.

9.6  No Condition of Purchase.  Consent to receive marketing calls, texts, and emails is not a condition of purchasing any product or service from Company. You may use the Services and purchase a Subscription whether or not you consent to marketing communications; however, transactional and service messages will be sent regardless of marketing consent.

10.  INTERNATIONAL DATA TRANSFERS

10.1  Data Processed in the United States.  Company is operated from the United States. If you access the Services from outside the United States, your Personal Information may be transferred to, stored, and processed in the United States or in any other country where Company, its Affiliates, or Service Providers operate. If you believe Company has collected information from a child, contact support at propertytracker.com.

13.  THIRD-PARTY LINKS AND SERVICES

The Services may contain links to, or integrations with, third-party websites, tools, and services not operated by Company. This Policy does not apply to those third parties, and Company is not responsible for their privacy practices, content, or security. Company makes no representations about and assumes no liability for any third-party website, platform, or service.

14.  DO NOT TRACK

Company’s Services do not currently respond to browser “Do Not Track” (DNT) signals because no uniform industry standard for honoring such signals has been established. Company reserves the right to address DNT signals if and when a standard is adopted. California residents may contact us regarding Company’s “Shine the Light” practices under Cal. Civ.
