Welcome to PropertyTracker.com. By accessing or using our website, software, mobile applications, or services, you agree to be bound by the terms and conditions contained in this Terms of Service Agreement (“Agreement”). If you do not agree to these terms, please do not use the Service.
1. SCOPE OF THE AGREEMENT
This Agreement applies to all PropertyTracker.com websites, electronic channels, software applications, and tools (collectively, the “Services”). This includes the Property Tracker, Property Evaluator, and any associated investor communities or consultation services provided under our Premium tiers. This Agreement applies regardless of the device or method used to access the Services.
2. SERVICE TIERS AND FEATURES
PropertyTracker.com offers different levels of service. You agree to the specific terms associated with your selected plan:
- Free Plan: Grants limited access to basic features. PropertyTracker.com reserves the right to limit storage, properties, or data history for free accounts at any time.
- Pro Plan: A paid subscription that unlocks advanced tracking features, unlimited property data, and reporting tools.
- Premium Plan (Consultations & Community): This plan may include access to third-party platforms, investor communities, or educational consultations managed by PropertyTracker.com or its affiliates. Disclaimer: Any information provided during consultations, coaching calls, or within the community is for educational and illustrative purposes only. It does not constitute financial, legal, tax, or real estate brokerage advice.
3. BILLING, RENEWAL, AND CANCELLATION
Subscriptions and Auto-Renewal: For Pro and Premium plans, your subscription will automatically renew at the end of each billing cycle (monthly or annually) unless you cancel prior to the renewal date. You authorize PropertyTracker.com to charge your payment method on file for the renewal rate.
Cancellation: You may cancel your membership at any time via the “Membership Info” link in your account settings. Cancellation takes effect at the end of your current billing period. We do not provide prorated refunds for unused time in the current billing cycle.
4. REGISTRATION AND ACCOUNT SECURITY
You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials. You explicitly agree not to share your username and password with individuals outside your immediate organization or household. You are responsible for all activities that occur under your account.
5. LICENSE AND RESTRICTIONS
PropertyTracker.com grants you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your personal or internal business real estate management. You agree NOT to:
- Use the Services for any unlawful purpose.
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission.
- Use any robot, spider, scraper, or other automated means to access the Service for any purpose.
- Input data that contains viruses, malware, or any other malicious code.
6. NO INVESTMENT OR LEGAL ADVICE
The Services are for information and management purposes only.
Although PropertyTracker.com provides tools to evaluate financial performance, we are not a financial advisor, legal counsel, or tax professional. Real estate investments carry inherent risks. The projections, “Market Information,” and reports generated by the Service are based on user inputs and estimates; they are not guarantees of future performance.
You assume sole responsibility for evaluating the merits and risks associated with the use of any PropertyTracker.com service. You agree not to hold PropertyTracker.com, its affiliates, or its third-party providers liable for any possible claim for damages arising from any decision you make based on information made available to you through the Service.
7. MARKET INFORMATION AND THIRD PARTIES
PropertyTracker.com may display “Market Information” (e.g., interest rates, property values) obtained from third-party providers. We do not guarantee the accuracy, timeliness, or completeness of this data. Market Information may change rapidly due to economic conditions. We are not obligated to update any such information.
8. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
PROPERTYTRACKER.COM EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DATA LOSS WILL NOT OCCUR.
9. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES SHALL PROPERTYTRACKER.COM, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW, IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF PROPERTYTRACKER.COM TO YOU EXCEED THE AMOUNT PAID BY YOU TO PROPERTYTRACKER.COM DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR $100.00, WHICHEVER IS GREATER.
10. INDEMNIFICATION
You agree to indemnify and hold PropertyTracker.com harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your content, your use of the Service, your violation of this Agreement, or your violation of any rights of another.
11. GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by the laws of the State of California without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the City and County of San Bernardino, California.
12. MODIFICATIONS TO TERMS
PropertyTracker.com reserves the right to update or modify these Terms of Service at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.
